Summary

David Winch
  • David Winch is solely responsible for the collection and processing of all personal data within this organisation
  • We currently collect and process personal data about our Clients, our Prospects, ‘Subscribers’ to our Free E-Mail Bulletins, and our Suppliers
  • Details of what we do with your personal data are given below
  • Details of your right to inspect and/or request corrections to your personal data is also shown below, as is the process for opting out of receiving some or all of our communications

Information

When someone visits this site we collect standard internet log information and details of visitor behaviour patterns.  We do this to find out things such as the number of visitors to the various parts of the site.
We collect this information in a way which does not identify anyone.  We do not make any attempt to covertly find out the identities of those visiting our website.  We will not associate any data gathered from this site with any personally identifying information from any source.
If we do want to collect personally identifiable information through our website, we will be up front about this.  We will make it clear when we collect personal information and will explain what we intend to do with it.

Registration

Registration for any form of free information, material, service or contact is not required simply to view the Site.  If you elect to register for any free information, material, service or contact, David Winch asks you for information that enables us to deliver such information, material or service, or to make such contact.

About David Winch

I am a sole trader so I wear all the ‘hats’ in my business.

The Personal Data We Collect

We currently collect personal data about our Clients, our Prospects, ‘Subscribers’ to our Free E-Mail Bulletins, and our Suppliers.  We never ask for or store special categories of sensitive information about any individual living person.  We have recently migrated our website to HTTPS to ensure the security of your personal data communicated by its use.

Where and How We Store Your Data

Your information is stored on a computer at the UK premises of David Winch (of which I am the sole resident), plus on a physical back-up copy stored elsewhere on our premises.
Because we use the services of an e-mail broadcasting company based in the USA to distribute our bulletins, your data (unless you are only a Supplier) may also be stored on their servers.

What We Do With Your Data

  • Clients
    • We will use your personal data as necessary to fulfil our Sales Contract with you, and to send you invoices and payment receipts
    • Based on your purchase, we believe you will be interested in our regular, free e-mail bulletins of Sales, Marketing and Pricing tips and guidance - plus occasional offers - so we will add you to our mailing list and hope these bulletins will enhance your business performance, and trust that you will deal with us again in the future.  You may unsubscribe from the bulletins at any time using the link provided in each e-mail.
    • We will retain your information indefinitely in order to prevent us treating you incorrectly at any time in the future.
  • Prospective Consultancy Clients
    • Based on the information available in the public domain about your business matching one of our ‘ideal client’ profiles, we believe you may have an interest in our services and products.  We will attempt to make contact with your organisation in order to determine the name of the most appropriate person to approach.
    • Having been offered your personal information, we will attempt to speak to you to confirm your interest and to make an appointment to visit you to determine how the needs and wants of your company match the services we can provide
    • Once we have made contact, we will continue to keep in touch, until or unless you request we visit you, you engage us or you ask us to desist.  If we agree that the time is not right for us to work together, we will offer you the chance to join the list of those who receive our regular, free e-mail bulletins of Sales, Marketing and Pricing tips and guidance - plus occasional offers.  You may unsubscribe from these bulletins at any time using the link provided in each e-mail.
    • We will retain your information indefinitely in order to prevent us treating you incorrectly at any time in the future.
  • Prospective Coaching Clients
    • Based on your request for some of my free material via our website, social media, electronic communication, on the phone or by us meeting in person, if we believe you may have an interest in receiving further regular, free e-mail bulletins of Sales, Marketing and Pricing tips and guidance - plus occasional offers - we will add you to our mailing list and hope these bulletins will enhance your business performance.  You may unsubscribe at any time using the link provided in each e-mail.
    • We will retain your information indefinitely in order to prevent us treating you incorrectly at any time in the future.
  • Free Bulletin Subscribers
It has already been stated above how people arrive on the mailing list for our free regular e-mail bulletins and the fact that, to send the bulletins out, we use an e-mail broadcaster, and that you can unsubscribe from these bulletins at any time using the link provided in each e-mail.  As well as this we use the broadcaster’s additional services to apply the following processes to your data.
    • New subscribers receive a short standard sequence of e-mails
    • Established subscribers receive the latest bulletin every time
    • The broadcaster detects bounced e-mails and Unsubscribe Requests and blocks further messages from being sent to those addresses
    • We are able to discover exactly who has opened each e-mail and we record when each subscriber last opened a bulletin on the broadcaster’s system.  We believe this to be indicative of your continued interest but we also use this information to allow us to stop sending to those who do not open an e-mail for thirteen weeks, or who never open one in their first thirteen weeks of membership.  Very occasionally, and this may last for more than one issue but not for very many, we send to those excluded by our rule.
    • The general format of our e-mails is to have the first few paragraphs of an article and then a link to the whole article.  We are able to discover which subscriber clicked or tapped which link in which e-mail.  We record the details on our own system and just the fact of clicking/tapping a link at least once on the broadcaster’s system.  We can then use this information to present offers more frequently to those who are known to be willing to follow links in our e-mails.
    • We will retain your information indefinitely in order to prevent us treating you incorrectly at any time in the future.
  • Express Consent
    • If you have given us your express consent to receive a certain type of communication from us on a certain topic, we will follow your wishes.  We may also send you other forms of communication and/or on other topics based on our belief in the legitimate interest you would have in receiving them.
  • Suppliers
    • We will use your personal data as necessary to place purchase orders with you, to make payments, and for our bookkeeping and the legal requirement to keep our business records for a number of years
    • We will retain your information indefinitely in order to prevent us treating you incorrectly at any time in the future and to minimise duplication within our Supplier database

Aggregate Information

From time to time, external services we use may collect general, non-personal, statistical information about the use of our site, such as how many visitors visit a specific page, how long they stay on that page, and which hyperlinks, if any, they "click" or "tap" on.  They collect this information through the use of technologies such as "Cookies" and "IP Addresses", which are discussed in greater detail in our Anti-Spam and Cookie Policy.  However, please be assured that this aggregate data will in no way personally identify you, other list members or any other visitors to the site.

Clear Gifs (Web Beacons/Web Bugs)

Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users.  In contrast to cookies, which are stored on a user's computer hard drive or phone internal memory, clear gifs are embedded invisibly in HTML files and are about the size of the full stop at the end of this sentence.
We may use clear gifs in our HTML-based e-mails to let us know which e-mails have been opened by recipients.  This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.  On some pages of this site we may encode clear gifs in order to make use of Google AdWords remarketing facility to show our Adverts on other web sites, and to make use of PayPal to collect payments.  Each of our Adverts that you see on another site will contain a link to enable you to stop seeing our Adverts should you not wish to do so in future.

Profile

Through our use of Analytics, Adwords and other Google services, Google may store information that they collect through cookies and clear gifs to create a "profile" of your preferences.  They may tie your personal information to information in the profile to provide tailored promotions and marketing offers for you.  We do not have access to your profile so we could never share your profile with, or sell it to, any third parties.

Information Sharing and Disclosure

Except for the limited situations listed here in this Privacy Policy, we will not share your personal information with third parties.  David Winch is opposed to SPAM and actively encourages internet users and site owners to be aware of, understand and comply with anti-spam regulations.

Choice/Opt-Out

E-mail messages may be required to fulfil our services to you.  If you do not wish to receive them you may opt-out of these communications, which are not promotional in nature, and/or deactivate your account by following the instructions included in each communication or by contacting David Winch Support at david@davidwinch.co.uk
You may also use this address to ask us at any time to let you know what information we hold about you.  We will respond within a reasonable time and we reserve the right to make a charge for this service.  Should you then wish to ask us to correct any errors, we will do so within a reasonable time.  You make also use this address to express your wish to opt out of some or all of our communications and again we will fulfil your wishes within a reasonable time.  We believe that is in both our interests to retain your basic contact information indefinitely in order to prevent us treating you incorrectly at any time in the future.

Links to Other Sites

Please be aware that when you are on our website, or when you receive an e-mail message from us, you could be directed to other sites that are beyond our control.  There may be links to other sites from this site's pages or from the e-mail message we send to you that take you outside our site.  These other sites may send their own cookies to visitors, collect data, or solicit personal information.
The privacy policies of these other sites may be significantly different from this Privacy Policy.  We are not responsible for the privacy practices of these other sites and cannot guarantee the security of any of your personal information collected there.  Note that when you link to a third party site from this site, you may see pre-populated data fields with your personal information; however, that information is not available to the third party unless you take certain actions on the third party's site, such as submitting a form.

Privacy Policy for Children

We do not knowingly collect information from children under the age of 13 on the site or through any services we may provide.  If you are under the age of 13, please do not provide any information to us.  If we become aware that we have collected information from a child under the age of 13, we will make commercially reasonable efforts to completely delete such information from our database.

Changes to this Policy

The terms of this Privacy Policy may change from time to time.  We will notify you of any material changes to this Privacy Policy by posting a notice on the homepage of our website for a reasonable period of time after such changes are made, that this Privacy Policy has been updated, and by changing the "Effective" date at the top of this Privacy Policy.  We encourage you to check this page periodically for any changes.  Your continued use of this site and participation in any activities involving this site in any way following the posting of changes to these terms, will mean you accept those changes.

Aggregate Information
Learn More

From time to time, external services we use may collect general, non-personal, statistical information about the use of our site, such as how many visitors visit a specific page, how long they stay on that page, and which hyperlinks, if any, they "click" or "tap" on. They collect this information through the use of technologies such as "Cookies" and "IP Addresses", which are discussed in greater detail in our Anti-Spam and Cookie Policy. However, please be assured that this aggregate data will in no way personally identify you, other list members or any other visitors to the site.

Clear Gifs (Web Beacons/Web Bugs)
Learn More

Profile
Learn More

Through our use of Analytics, Adwords and other Google services, Google may store information that they collect through cookies and clear gifs to create a "profile" of your preferences. They may tie your personal information to information in the profile to provide tailored promotions and marketing offers for you. We do not have access to your profile so we could never share your profile with, or sell it to, any third parties.

We make every effort to ensure that we accurately represent our products and services and their potential for producing results for business owners who apply them conscientiously and diligently. Examples of sales, profits and other results are not necessarily average or typical nor intended as representations of potential earnings. As with any business or training, each individual's results may vary widely. Each individual's results depend on his or her background, dedication, desire, motivation and particular applications. Significant financial risk is possible with any business venture or opportunity if you don't do your own due diligence and get suitable professional advice. Results are not guaranteed. Everyone who implements the advice and guidance given does so with the understanding that they are responsible for creating their own results.
